OVERVIEW

The Georgia Department of Public Safety (DPS) employs approximately 1600 employees and oversees the day-to-day operations of the Georgia State Patrol (GSP), Capitol Police and the Motor Carrier Compliance Division (MCCD). GSP troopers investigate traffic crashes and enforce traffic and criminal laws on the state's roads. Capitol Police officers prevent and detect criminal acts and enforce traffic regulations throughout Capitol Hill. MCCD officers conduct safety inspections of commercial motor vehicles and inspect highway shipments of hazardous materials.

The mission of the Department of Law is to serve the citizens of the State of Georgia by providing legal representation of the highest quality to the agencies, officers, and employees of state government and by honorably and vigorously carrying out the constitutional and statutory responsibilities of the Attorney General. The position filled through this announcement will serve in the White Collar and Cyber Crime Section of the Prosecution Division.

 

Job Title: Assistant Attorney General

 

Job Summary

Attorneys in the White-Collar and Cyber Crime Section investigate and prosecute public corruption of elected officials and agencies, fraud involving the State of Georgia’s departments and agencies, cyber-enabled theft, criminal violations of the Fair Business Practices Act, identity fraud, and a variety of other criminal offenses. The ideal candidate will have at least 1 to 5 years of litigation/prosecution experience and a strong interest in cryptocurrency, cyber-enabled fraud, and financial crimes.

 

Being a prosecutor in the Attorney General’s Office is unique and unlike any other prosecution position in our state.  We have statewide jurisdiction over the conduct we can prosecute, which means we can go where the evidence takes us and not stop at the county line.  Our prosecutors dig into complex cases involving emerging areas of law while also handling more routine matters.  We do this with a fantastic team of lawyers and administrative staff who are always willing to lend a hand and make sure everyone is supported and successful.

 

Primary Duties & Responsibilities

Investigations

  • Analyzes complaints and allegations to determine whether an investigation is warranted.
  • Participates in the investigation of criminal allegations and coordinates with internal and external investigators from a variety of law enforcement agencies.
  • Prepares subpoenas and other legal process under the Attorney General’s statutory authority.
  • Reviews records to determine sufficiency of evidence.

 

Litigation

  • Drafts charging documents.
  • Engages in all phases of criminal prosecution including investigation, grand jury, motions practice, discovery, plea negotiations, witness preparation, and jury trials.
  • Attends all court calendars.
  • Works with expert witnesses.
  • Writes appellate briefs and appears before the State’s appellate courts.

 

Other Duties

  • Interacts with State agencies on emerging legal issues.
  • Conducts research on pertinent legal issues; keeps abreast of recent legal developments.
  • Participates in multistate and multiagency working groups.
  • Reviews sign-on opportunities for letters, comments, and briefs.
  • Drafts formal opinions in response to legal questions.
  • Responds to inquiries from citizens, legislators, and judges.
  • Attends client, board, departmental, and division meetings as required.
  • Attends continuing legal education seminars as required; makes presentations at same.
  • Travel, as required by the position (typically not much travel is required).
  • Performs other related duties as assigned.

Minimum Qualifications

  • Graduation from an accredited law school and Member of the Georgia Bar

Preferred Qualifications

Preference will be given to applicants who possess one or more items below:

Three (3) or more years of litigation or prosecution experience; familiarity with emerging issues in cyber-enabled theft cases; strong interest in cryptocurrency; and strong legal writing skills.
