Commercial Pre-Let Attorney

Primary Duties & Responsibilities:

·         Provides advice about pre-let Design-Build and P3 procurement issues based on precedent, contract language, relevant laws and regulations, Department business priorities, and programmatic commercial considerations, as well as industry trends.

·         Works with P3 Division Procurement team implementing coordination between Contracting Officer, Project Manager, SMEs and external technical, legal and financial advisers.

o   Meets with pre-let team on deal/decision points for local government agreements to align with DB or P3 Agreement

o   Meets with local government legal representatives, project teams, and on smaller legal calls as needed

o   Coordinates with pre-let team on project issues related to access aesthetic improvements, CID issues, stormwater, and other project specific issues

o   Works with pre-let team and external legal advisors, as needed, on template contract documents and adaptation of templates for each project

o   Coordination with internal and external financial advisers on funding and project finance issues

o   Participates in commercial procurement meetings and certain ATC meetings with commercial implications

o   Reviews all agreements related to P3 Division projects for legal sufficiency and commercial consistency

MINIMUM QUALIFICATIONS

The selected candidate must meet the advertised minimum qualifications to include State Entry Qualifications as well as Agency Specific Qualifications.

 

Agency Specific Qualifications:

·         Juris Doctorate from an accredited college or university

·         Five (5) years of legal experience that includes contract negotiation and drafting

·    Working knowledge related to at least one of the following areas: construction industry, procurement law, commercial contracts, corporate law, environmental law, public private partnerships, alternative delivery project contracts, project finance, and/or regulation interpretation and compliance

·    Demonstrated excellent communication skills with demonstrated experience expressing ideas and facts to individuals or groups effectively

·         Facilitates an open exchange of ideas

·         Demonstrated experience identifying and analyzing problems

·         Demonstrated experience distinguishing between relevant and irrelevant information to make logical judgements

·         Demonstrated experience to quickly adapt to change including new policies and procedures

·         Displays high level of self-motivation

·         Demonstrated ability to recognize opportunities to help the organization accomplish its objectives

·         Possesses good time management skills

·         Strong customer orientation.

 

 

Agency Preferred Qualifications

·     Working knowledge of and experience related to two or more of the following areas: procurement law, public private partnerships, alternative delivery, corporate law, project finance and/or regulation interpretation and compliance

·         License to practice law in the State of Georgia or eligibility to obtain Georgia licensure

 

 

Associate degree and managerial or supervisory role; or one (1) year at the lower level Mgr 1, Transport Specialist (TRM030) or position equivalent.
